Michigan man wins $25,000 lawsuit against parents for throwing away his porn collection

U.S. District Judge Paul Maloney has ruled that David Werking may recover at least $25,000 and potentially up to $75,000 (treble damages) from his parents, who threw away his property. Werking’s parents threw away 12 boxes of pornography and sex toys comprising 1,605 DVDs and VCR tapes and approximately 50 sex toys. Werking’s parents have until February 16, 2021 to submit written submissions in order to keep the amount they owe down to a minimum.

After Werking divorced in 2016, he temporarily moved into his parent’s home in Glen Haven, Michigan. A few months later Werking moved to Muncie, Indiana, and that is when he discovered the missing 12 boxes. In an email, Werking’s father admitted to throwing away the porn and sex toys. According to the email, his father thought some items were child pornography and involved non-censual sex. The sheriff’s office reviewed the tossed items, and they found nothing to be illegal.
