Bradenton, Fla — Last night, September 4, 2016, the Libertarian Party of Florida Executive
Committee met and voted to officially oppose three Third District Court of Appeal judges. The three judges are Edwin A. Scales, III who was appointed by Florida Governor Rick Scott; Linda Ann Wells and Frank A. Shepherd. The political party is coming out opposing the three judges based on what the party sees as unconstitutional rulings in this Miami, Florida-based court.
Here is the text of the official resolution that passed:
Whereas, the Constitution of Florida gives Florida voters the right to vote on whether they want to retain or not judges that serve on the Florida Supreme Court and the various District Courts of Appeal throughout the State;
Whereas, Miami-Dade County and Monroe County are both parts of the Third District Court of Appeal and their voters will have the choice to vote on whether or not they wish to retain three Judges on that bench during the general election of 8 November 2016;
Whereas, Judge Edwin A. Scales, III of the Third District Court of Appeal is one of those judges as he was appointed first in 2013 by Governor Rick Scott;
Whereas, Judge Edwin A. Scales, III has failed to preserve the integrity of the government by ruling in favor of policies that give more weight to police officers’ testimonies over witness testimonies in cases involving police assault, as is evidenced by Raul Diaz v. State of Florida;
Whereas, Judge Linda Ann Wells of the Third District Court of Appeal is one of those judges as he was retained for the second time in 2010;
Whereas, Judge Linda Ann Wells has failed to preserve the constitutional rights of Floridians by arguing that municipalities that grant American Traffic Solutions the discretionary power to review images of violations and issue citations involving the use of red light cameras did not overstep their powers, as evidenced in State of Florida v. Luis Torres Jimenez;
Whereas, Judge Frank A. Shepherd of the Third District Court of Appeal is one of those judges as he was retained for the second time in 2010;
Whereas, Judge Frank A. Shepherd has failed to preserve the constitutional protections of students by allowing evidence gathered after a warrantless search in a student’s book bag, as evidenced in K.P. v. State of Florida;
Whereas, the Libertarian Party of Florida stands for just and fair interpretation of the Florida constitution as well as holding law enforcement accountable for actions which violate the rights of the individual;
the Libertarian Party of Florida shall hereby officially oppose the retention of the Third District Court of Appeal Judge’s Edwin Scales, Linda Wells and Frank Shepard.
